Tuxedo Reserve also cannot hook into the existing Town of Tuxedo Sewer Facility. Tuxedo Reserve’s amended proposal therefore cannot be approved. In addition, Tuxedo Reserve cannot build a new sewer facility in exchange for zoning approvals. Contract Zoning is unconstitutional.
